Moxon, a Scientology lawyer who has been removed as lead counsel for Jason
Scott in the CAN bankruptcy case.

Jessie Blalock transcribed a CNN report on the controversy of Germany
against Scientology.
"Introducing Dianetics, religion or ruse? Outside Scientology headquarters in the Northern German city of Hamburg, handing out pamphlets has gotten to be at times hazardous duty. Insults, even physical attacks. Scientologists in Germ nay say daily, they're demonized.
"Savine Weber, Female Scientologist - 'Dismissed from their jobs, boycotted, spit at, slighted, bomb threats, murder threats, broken glasses, graffiti on the house, on the wall, physically attacked, I mean, the main thing is that they're being isolated form society.
"Announcer: A fax Scientologists say arrived at the Hamburg office. 'Jews were gassed', it reads, 'why not Scientologists?'. Still, Scientology critics in Germany say the church's repeated comparison of campaigns against it, as here in the New York Times, to the Nazi persecution of the Jews, is over the top.
"One criticism of Scientology - once you start, critics say, dependency is created - a need for ever more expensive auditing, counseling sessions to, as Scientologists say, go 'clear'.
"(Disguised female form shown in shadows). 'The woman we'll call 'Gabriella' says she spent more than $100,000 on an organization thats only interest is control. 'Scientology is against any kind of freedom, of human beings, of governments. That's what so dangerous about it. Scientology is a totalitarian organization They want power.'
"Announcer: 'A misreading, Scientologists say, of their freely acknowledged interest in winning as many hears and minds as possible, for a cost, they freely admit, can reach tens of thousands of dollars. In Germany, as in few other places, it's understood how wrong things can go when people lose the right to believe what they will. What's also understood, though, the delicate balance, how vulnerable people can be to the allure of something with all the answers.'"
Reuters reported this week that Germany has agreed upon the actions it will take at the state and federal levels against Scientology.
"Germany's federal and regional governments agreed on measures at a meeting Wednesday to counter what they called the 'expansionist aims and claim to domination' of the Church of Scientology. The package aimed to establish a unified approach against the U.S.-based group after a number of politicians and regional states called for action against what they allege is a profit-making, pseudo-religious sect relying on manipulation.
"'The federal and state governments agree that the dubious activities of the Scientology organization and its expansionist aims and claim to domination must be countered determinedly with all legal means,' the governments said in a statement.
"The governments also agreed to exclude Scientologists as far as legally possible from public contracts for installations requiring a special degree of trust, such as education and advice centres. They said they would also consider legal regulation of groups offering people, on a commercial basis, help in coping with their lives."
Reuters also reported on Scientology's response.
"The Church of Scientology lashed out against German federal and state governments on Friday for a series of measures taken to counter the organisation. 'It feels like religious cleansing,' the Church of Scientology Germany said in a statement. 'It feels as if they want to take away German citizenship from those who think differently.'
"'In the interest of democracy in our country, the Scientology members will take legal action against this totalitarian trend,' a Church of Scientology spokesman said."
U.S. State Department spokesman Nicholas Burns had this to say about the measures:
"I've just seen a brief report from our Embassy in Bonn just in the last hour that the German Government has made a basic decision to form a group to take a look at the issue of Scientology in Germany. The report I saw was quite straightforward but did not have a lot of detail, and it essentially said that Chancellor Kohl and his Ministers had decided to study the issue in all of its aspects.
"It did not, as far as I saw, announce any Draconian or repressive measures against the Church of Scientology. In fact, I think the German Interior Minister said in a press conference in Bonn two days - on the 16th of December - that Germany would not try to shut down the Church of Scientology in Germany, and that's good news, indeed."

to take longer than originally thought.
"[O]n December 7, 1996 District Judge Ronald M. Whyte continued the hearing 'on the papers' (no oral argument) of my Motion to Amend Counterclaims to February 14, 1996. Because of this move I have decided also to reschedule the Depositions of scientology Managing Agent David Miscavige and President Warren McShane to correspond to a ruling on this matter, or to other scheduling orders.
"The longer the time until cut-off the better for me, a pro per proceeding in forma pauperis because it allows me to collect more collateral evidence relating to my RICO counterclaim and permits me more time to learn court procedure and legal principles -- not to mention dealing with a dilatory and evasive adverse party who is supported by six attorneys in four law firms.
"I will be filing a Motion to Compel and a Motion to hold in Contempt later in the week and likely several such motions in January, 1997 relating to evasive responses by the plaintiff to certain interrogatories and documents requests, as well as initial disclosure."

Lisa McPherson
The death of Scientologist Lisa McPherson in late 1995 has generated a
series of articles in Florida Newspapers this week, as public interest in
the circumstances of her death grows. From several Tampa Tribune
articles:
"McPherson said she hoped to visit for Thanksgiving, but she was instead taken to the Fort Harrison Hotel, the church's headquarters in Clearwater, on November 18, 1995. On that night, McPherson was waiting in traffic and mistakenly bumped into the back of a boat trailer being hauled by a truck. After a brief stay in the hospital, she was taken to the hotel by church member. No physical injuries were found police said.
"'She goes to (the church's headquarters) for rest and relaxation and the next time there's any indication of what's happening to her is that on December 5, 1995, she shows up at a hospital in New Port Richey and she's dead on arrival.' said Clearwater Police Det. Sgt. Wayne Andrews.
"An autopsy by the Pinellas-Pasco Medical Examiner's Office showed McPherson's 5 foot 9, 108- pound body was severely dehydrated, her arms and legs were bruised, her skin was cracked and scaling. Her left pulmonary artery was blocked by a fatal blood clot brought on by dehydration and 'bed-rest,' the autopsy report said."
"Police have questions about McPherson's death. Detectives wanted to talk with Scientology employees Suzanne Schnuremberger, Ildiko Cannovas and Laura Arrunada, but were told by the church that all three had left the country. They are still being sought for questioning.
"Johnson said those people no longer work for the church and Scientology doesn't know how to locate them. Clearwater Police Detective Sgt. Wayne Andrews said he thinks Schnuremberger is in Switzerland or Germany, Cannovas is probably in Hungary and Arrunada may be working in the medical field in Mexico. He recently asked for help locating them by posting a request for information on the Internet.
"The three former employees 'worked in an office that would have had control over her' during her stay, Andrews said. Church of Scientology spokesman Brian Anderson said that is false. He said the three have no connection to McPherson's death and the investigation is nothing more than a harassment campaign against the church by police.
"After her daughter's death, Fannie McPherson came to Clearwater, where she learned of the traffic accident and the odd behavior. She said her daughter's Scientology friends told her that, upon arrival at the Fort Harrison on Nov. 18, Lisa McPherson was put in 'baby watch,' which an ex-church member says is Scientology terminology for solitary confinement.
"Ex-church members say such confinement is used when a member has a 'psychotic break' or is threatening to flee the church. 'They are put in a room with no one and nothing,' said Dennis Erlich, a former Scientologist who now is an activist against the church."
"In a statement released Monday, Scientology officials claim the police 'planted a false story in The Tampa Tribune for the express purpose of creating hate and prejudice against the Church of Scientology.'
"In the statement, Scientology spokesman Brian Anderson and church attorney Robert Johnson say McPherson had a 'deadly staphylococcus infection.' Larry Bedore of the Pinellas-Pasco Medical Examiner's office, which conducted the autopsy, confirmed Monday McPherson did have a staph infection, but said it was not the cause of death."

"Two months before she died, McPherson reached the level of 'clear,' a major goal for Scientologists. 'Clear' is attained after many hours of spiritual counseling, which Scientologists believe rids them of undesirable forces such as irrational fears that lurk in the subconscious.
"Dell Liebreich of Dallas, McPherson's aunt, said her niece had back problems sometimes but no other physical ailments. Fannie McPherson last spoke to her daughter by telephone some time before the accident, Liebreich said. She said McPherson mentioned to her mother that people at work 'were badgering her about her sales,' so she would not be home in Dallas for Thanksgiving because she was too busy.
"'We thought she was happy except for that time she called and told her mother that she felt she was letting people down at work,' Liebreich said. 'She led Fannie to believe that maybe she might want to leave the church but never said that in so many words.'
"According to Liebreich, McPherson's records included IRS documents showing she made $140,000 one year. Scientology officials said Monday that she earned $70,000 to $80,000 a year. Liebreich said McPherson died with $11 in her savings account."

PA News reported that a member of the British House of Lords has announced
he is a Scientologist.
"A Liberal Democrat peer today disclosed he is a member of the Church of Scientology, as a Home Office minister warned of the 'potential dangers' of becoming involved in such organisations.
"In Lords question time exchanges on the operations of the organisation, Lord McNair, 49, declared: 'I have to tell the House that I have an interest -- and that interest is that I am a member of the Church of Scientology.'
"Tory Baroness Sharples earlier told the House: 'Those who have left the cult, a number of them, have been both threatened and harassed and a considerable number of them have been made bankrupt by the church.' Home Office Minister of State Baroness Blatch said: 'People should be warned of the potential dangers of becoming involved in organisations of this kind.'"

"Another busy week at the University of Linkoping, Sweden. The president's house is receiving a lot of faxes from CoS lawyers in U.S. demanding the University to take action against my mail service. Right now they don't know what to do, there is no copyrighted material on my homepage but I'm still using a University server to post my mails containing NOT's. Rick Ross
Rick Ross, deprogrammer of Jason Scott among others, has unveiled a web
page.
"http://www.rickross.com is of course Rick Ross, the famous deprogrammer that Jason Scott sued. His web page has tons o' stuff on all kinds of groups, including Scientology."
The Phoenix New Times weekly newspaper reported that Rick is free from a $3 million judgment in the Scott case, and provided some details of the switch from Kendrick Moxon to Graham Berry.
"Scott and Ross reached a settlement that requires the deprogrammer to pay Scott not $3 million--his share of the judgment--but a mere $5,000. As part of the agreement, Ross will also give Scott 200 hours of professional services, free of charge.
"Meanwhile, Scott has reunited with his mother, who hired Ross to do the deprogramming, and has fired his attorney, Kendrick Moxon, a member of the Church of Scientology, which has a history of opposing Ross. Scott's new attorney is Graham Berry, who is well-known for his role in litigation against the Church of Scientology.
"Berry suggested that his new client may take legal action over the handling of the bankruptcy case. 'I have put both the trustee in bankruptcy and Mr. Moxon on notice of a possible lawsuit by Jason Scott for what has been done.'
"Moxon counters with claims that Jason Scott has been coerced into firing him.
"'Jason Scott was kidnaped by these people. He was deprogrammed. I think he's being held prisoner,' Moxon says, but he admits that he has no proof that Scott is being coerced or imprisoned.
"He also claimed not to know where Scott was being 'held.' However, Moxon knew enough, apparently, to show up at the home of Kathy Tonkin in Lake Montezuma December 6 where Jason Scott is presently staying. Accompanied by a Yavapai County sheriff's deputy, Moxon served subpoenas on Tonkin and Scott and engaged in a heated discussion with them. The sheriff's office confirms that, at Tonkin's request, Moxon was then escorted by the deputy from her property.
"'Mr. Moxon has refused to turn over any [of Scott's legal] files and has filed a motion in the federal district court in the state of Washington requesting a hearing on whether or not Jason Scott is being held captive and is acting against his will,' Berry says. (On December 5, the federal court refused to consider Moxon's motion.)"

Russian Taxes
Arnie Lerma posted an article from TASS in November 1996, describing the
seizure of property from the St. Petersburg, Russia org.
"Department of a Federal tax police service of RF (Russian Federation) in St.-Petersburg has arrested property of city's Scientology centre for failure to meet requirements about repayment of debts on payments. 1.2 million rubles (about $240) is withdrawn from the safe of organization. Computers, audio- and video equipment, other property and office equipment are left to the chairman of centre on a storage in a rented room under the criminal liability.
"The resolution about immediate payment of the taxes and penalties was made by results of checking up centre's financial and economic activity yet in the beginning of September. In spite of the fact that the cash money are received to them, the scientologists have not obeyed to the requirement, and a few rubles total still appear on their settlement account.
"The penal sanctions to centre are made on more than 80 million rubles (about $16,000). The check up has confirmed known all over the world 'originality' of a money extraction way, for which the scientologists are in trouble from tax policemen of many countries."

Zenon Raid
Lars Westergren posted a detailed account of a visit by the court bailiff
to Zenon Panoussis' apartment to seize NOTS materials. Zenon was informed
beforehand, and a TV crew attended the visit.
"Critics present was myself, Brian and Anti-Cult. I knew that Anti-Cult was coming and filming with a video camera, but when a young guy was lurking in the hallway taking snapshots of people, I thought I was getting my first view of a real, in the flesh clam. It turned out it was Brian who was taking shots to be scanned later.
"First big showdown happened in the living-room with everyone present. The cameraman switched on the light on his camera and started running the tape, the light was almost blinding. She didn't like that it was a 'public spectacle' with us critics there, but Zenon retorted that it was his apartment so there he did what ever damn he pleased.
"At one time the discussion became a bit heated, they were talking at the same time, and the bailiff finally said 'Ok, Ok! Zenon, you have studied my brief carefully, could I get a moment to study yours in peace!?' The three bailiffs, Zenon and the older man went into the kitchen and closed the door behind them.
"Everyone came out into the living room. 'So, thats settled then.' Zenon and the bailiff shook hands, she even smiled (albeit briefly and not very warmly). The cameraman turned to the journalist and asked if he should shoot the bailiffs leaving, the journalist asked the bailiff if they could shake hands again while they were filming. The bailiff looked a bit annoyed and said something along the lines 'I hardly think that is necessary...' and walked out."
Zenon described the legal situation.
"In a decision one and a half month ago, the bailiff ordered me to hand over all material that was targeted by the courts' decision of seizure. That decision is in turn worded in a way that specifies the material in legal, rather than in factual terms. It says that 'infringing material' is to be taken into custody. Nowhere, neither in the courts' nor in the bailiff's decision, is it specified just which material is infringing. The sanction in case I do not comply with the order of the bailiff is a monetary penalty.
"I said that, as the order does not specify certain physical material in an unequivocal way, it is left to me to interpret it and decide just which material is infringing. I deny copyright infringement in general, but for the purposes of the discussion of this order (only), I will accept that the RTC has copyright to my version of the OTs and NOTs. That still doesn't make my possession of them an infringement. For the mere possession to be infringing, it is additionally required that the material has not been legally publicized, which I claim that it has been.
"The bailiff is in principle free to make a new decision at once, communicate it to me verbally and execute it immediately. Against immediate execution I argued that, considering the fact that I am fully cooperative and, although fighting, yet not illegally evading the bailiff's orders, the bailiff should not execute any new decision at once, but give me time to appeal it before it's executed."

"I just found out that Frank Gerbode, a psychiatrist, who is an
ex-Scientologist and a highly trained auditor and C/S who defected around
the same time as David Mayo in the early 80s has submitted a therapy
called TIR (Traumatic Incident Reduction) to a research product that is
underway by Florida State University professors of psychology, Charles
Figley and Joyce Carbonell. Gerbode's TIR, as it was described in a recent
article in a professional magazine, is, remarkably similar to dianetic
auditing. Gerbode is claiming himself to be the innovator of this
technique, with no reference at all to the fact that he was ever in
Dianetics/Scientology, much less that he plagiarized their technique! This
is a double scam, since Dianetics was a scam in the first place, and then
Gerbode falsely claimed that he was the inventor of the technique. Figley
is apparently completely ignorant of this fact, so I think that we should
all send him an e-mail and enlighten him as to what he is really doing
research on."
Joe Harrington posted additional details.
"Metapsychology has been around for well over 10 years, and he has trained
many people on it and written many articles about it. Sarge Gerbode was
one of the most respected auditors in the field and one of the first to to
take a stance against the injustices of 1982. His open letter of
resignation of his membership is a model of personal integrity. Sarge was
oppressed with frivolous lawsuits by the CofS for many years for providing
major financial support for former Scientologists being sued by the RTC.
"He is an MD and a psychiatrist, as were many of the people involved in
the original developments of Dianetics in the early 50's. Hubbard was in
no way the sole creator of Dianetics. He was only the guy who tried to
monopolize it and build a shrine unto himself. To suggest that Sarge has
somehow 'plagiarized' (sic) is absurd and suggests your lack of
understanding of the history of the subject matter. His description of the
similarities of TIR to some of Freud's and Roger's precepts is quite
correct. The California Assn of Dianetic Auditors (CADA) has been around
for almost 40 years and has absolutely no connection with Hubbard or the
CofS."
